Boulevard Mall Great Holiday Gift Card Giveaway – Official Rules

• ELIGIBILITY: Open only to legal residents of New York who are 18 years of age or older at the time of entry and the person named on the mailing.  Employees of Boulevard Mall (“Sponsor”), and any stores in Sponsor’s mall and its and their respective affiliates, subsidiaries, parent companies, representatives, agents, promotion and other vendor agencies involved in this promotion, and their immediate family members and/or those living in the same household (whether related or not), are not eligible.  Void where restricted, taxed or prohibited by law.
• HOW TO PLAY: Boulevard Mall Great Holiday Gift Card Giveaway postcards will be distributed to specific persons in pre-selected Zip Codes in the Boulevard Mall trade area, while supplies last.  For a complete list of Zip Codes, visit Guest Services at this shopping center’s location.  To play, visit this shopping center’s Guest Services center to have your postcard scanned by an authorized guest service representative.  Postcards may be scanned during regular business hours on November 10, 2006 – December 10, 2006.  If one of the following messages is revealed: “$10,” “$20,” “$50,” “$100,” “$500,” “$1,000,” a Boulevard Mall gift card with the corresponding value will be presented by the authorized guest service representative, subject to verification of potential winner’s eligibility and identity.  Limit one (1) Boulevard Mall Great Holiday Gift Card Giveaway postcard per person.
• VERIFICATION: All postcards are subject to verification and are void if (a) not obtained in accordance with these Official Rules and through legitimate channels, (b) any part is counterfeit, altered, defective, illegible, reproduced, tampered with, mutilated or irregular in any way or (c) contain printing, typographical, mechanical, seeding or other errors.  Winner’s name and address must exactly match name and address on postcard in order to be verified.  Decisions of the judges on all matters related to the giveaway are final and binding in all matters relating to the Boulevard Mall Great Holiday Gift Card Giveaway.  All materials submitted will become the property of the Sponsor and will not be returned or acknowledged.  Any postcard that is mutilated, altered, duplicated, tampered with, lost, not obtained legitimately, or distributed where restricted, taxed or prohibited by law will be deemed null and void.  Winning gift cards may not be transferred or sold.  Only postcards obtained via Rule #2 will be deemed to have been obtained legitimately.  In the event of a printing, production error or other error, neither Sponsor, nor any of its respective agents and agencies, shall have any liability.  If due to a printing, production or other error, more winning postcards are distributed, or more Boulevard Mall gift card prizes are claimed than intended to be awarded in Rule #4, the intended Boulevard Mall gift card prizes will be awarded in a random drawing from among all verified Boulevard Mall gift card prize claims received for that value.  In no event will Sponsor be obligated to award more than the stated number of Boulevard Mall gift card prizes.
• Boulevard Mall Great Holiday Gift Card Giveaway PRIZES: A total of ONE (1) $1,000 Boulevard Mall gift card (Odds of winning: 1:7,000); ONE (1) $500 Boulevard Mall gift card (Odds of winning: 1:7,000); FIVE (5) $100 Boulevard Mall gift cards (Odds of winning: 1:1,400); TEN (10) $50 Boulevard Mall gift cards (Odds of winning: 1:700); TWENTY FIVE (25) $20 Boulevard Mall gift cards (Odds of winning: 1:280); SIX THOUSAND NINE HUNDRED FIFTY EIGHT (6,958) $10 Boulevard Mall gift cards are available (Odds of winning: 1:1.1).  Total Approximate Retail Value of all prizes combined is $71,580.  Odds of winning a Boulevard Mall gift card are 1:1.  Certain conditions and restrictions may apply.  See Gift Cardholder Agreement for any applicable terms and conditions on gift card use.
• GENERAL RULES: Boulevard Mall Great Holiday Gift Card Giveaway prize winners of $1,000 and $500 Boulevard Mall gift cards will be required to complete an Affidavit of Eligibility and Release/Prize Acceptance form before the prize is awarded.  In the event any prize winner is considered a minor in his/her jurisdiction of residence, the prize will be awarded in the name of the minor’s parent/legal guardian and minor’s parent/legal guardian will be required to complete and return all required documentation.  Winners may make no substitution/transfer of prize; prize cannot be exchanged for cash.  All federal, state and local income taxes are the sole responsibility of the winner.  All federal, state and local laws and regulations apply.  Return of any postcard as undeliverable will result in disqualification, and an alternate may be selected.  Participation in Boulevard Mall Great Holiday Gift Card Giveaway constitutes permission by participants for Sponsor and its agencies to use winner’s name and/or likeness in perpetuity, in any media now known or hereafter developed, for advertising or publicity purposes without further notice or compensation, unless prohibited by law.  By participating in the promotion, participants agree to be bound by the Official Rules and decisions of the judges, which are final.  By participating, participants agree to indemnify, defend and hold Sponsor and each of Sponsor’s agents, employees, shareholders, contractors and insurers harmless against any and all claims and liability arising out of participation in this promotion or acceptance or use of any prize and for any claims based on publicity rights, defamation or invasion of privacy and merchandise delivery.  Winners assume all liability for any injury/damage caused/claimed to be caused by participation in this promotion or use/redemption of any prize.  As a condition of entering the Boulevard Mall Great Holiday Gift Card Giveaway, participants agree that (1) under no circumstances will participant be permitted to obtain awards for, and participant hereby waives all rights to claim punitive, incidental, consequential or any other damages, other than for actual out-of-pocket expense, (2) all causes of action arising out of or connected with this promotion, or any prizes awarded, shall be resolved individually, without resort to any form of class action and shall be resolved exclusively by arbitration under the rules of the American Arbitration Association; and (3) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this promotion, but in no event attorney’s fees.  Sponsor, affiliates, subsidiaries and agencies are not responsible for any typographical or other error in the printing, the offering or in the administration of the promotion.  In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any promotional materials and the terms and conditions of the Official Rules, the Official Rules shall prevail, govern and control.
• RESTRICTIONS: Sponsor is not responsible for any technical problems or any mechanical failures of the Boulevard Mall Great Holiday Gift Card Giveaway postcard scanners.  In the event of infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other failures or causes outside the control of the Sponsor which impair or affect the administration, security, fairness, integrity or proper conduct of this gift card giveaway, Sponsor reserves the right, in its sole discretion, to cancel, modify, suspend or terminate the affected promotion. 
• WINNER LIST: For the names of the Boulevard Mall Great Holiday Gift Card Giveaway winners, send a self-addressed stamped envelope to Boulevard Mall 703 Alberta Drive, Amherst, NY 14226 Attn: Marketing Director postmarked by February 15, 2007.
